Specifically, the lawsuit contends that customers faced numerous issues, such as receiving faulty or broken hot tubs and swim spas, and in some cases, incorrect measurements of their properties led to ill-fitting products being delivered. It was also noted that refunds were rarely issued, even if customers canceled their orders within the stipulated timeframe, resulting in significant financial losses for those affected.

A total of 30 customers have been identified as victims of these allegedly fraudulent practices, prompting the Attorney General to seek more than $394,000 in restitution alongside $330,000 in civil penalties for what the lawsuit describes as “willful violations” of Florida’s Deceptive and Unfair Trade Practices Act.

Shaun Jackrel, who is personally named in the lawsuit, is accused of overseeing the operations and endorsing the sales techniques that led to the alleged misconduct. In addition to monetary restitution, the Attorney General is calling for a permanent ban preventing Jackrel and his companies from engaging in the sales or advertising of hot tubs and outdoor kitchens in Florida, citing that the businesses’ actions have caused “substantial injury to the public.”

In parallel with the Attorney General’s lawsuit, Jacksonville Councilman Rory Diamond has filed a class action lawsuit against the same entities, reflecting a growing number of consumer grievances related to the companies.
